Burr's trial brought into question the ideas of executive privilege, state secrets privilege, and the independence of the executive. Burr's lawyers, including John Wickham, asked Chief Justice John Marshall to subpoena Jefferson, claiming that they needed documents from Jefferson to present their case accurately. Jefferson proclaimed that as President, he was "...Reserving the necessary right of the President of the U S to decide, independently of all other authority, what papers, coming to him as President, the public interests permit to be communicated, & to whom..."[13

Marshall decided that the subpoena could be issued despite Jefferson's position of presidency. Though Marshall vowed to consider Jefferson's office and avoid "vexatious and unnecessary subpoenas," his ruling was significant because it suggested that, like all citizens, the President was subject to the law.[14]

Marshall ruled that because Burr had not committed an act of war, he could not be found guilty (see Ex parte Bollman); the First Amendment guaranteed Burr the right to voice opposition to the government. To merely suggest war or to engage in a conspiracy was not enough.[15] To be convicted of treason, Marshall ruled, an overt act of participation must be proven with evidence. Intention to divide the union was not an overt act: "There must be an actual assembling of men for the treasonable purpose, to constitute a levying of war."[

He points out that neither invasion of Spanish lands nor secession of American territory was considered treasonous by most Americans at the time, in view of the fluid boundaries of the American Southwest at that time, combined with the widespread expectation (shared by President Jefferson) that the United States might well divide into two nations.[20]

Burr's Manhattan Company was more than a bank; it was a tool to promote Democratic-Republican power and influence, and its loans were directed to partisans. By extending credit to small businessmen, who then obtained enough property to gain the franchise,[clarification needed], the bank was able to increase the party's electorate. Federalist bankers in New York responded by trying to organize a credit boycott of Democratic-Republican businessmen.

Notes: I posted about Smedly Butler and the conspiracy he blew the whistle on...Bergy of the Millenia Millie tale engaged in similar effort-yesterday's post...the Civil War divided the country...Giants 6-5...I cant imagine the country broken up...Cinerama America the Beautiful "ride" at Disneyland...always to me...but in browsing I happened on Burr, missreading his name's spelling with Barr, current Attorney General...thought maybe a family relationship...remarkable what one happens on looking at family trees!...to bottom of sixth...brb...need to count the chickens...my nickname for browsing the vloggers latest postings!...bk...Angels win...walk off home run by LaStella...Angels 7-6...put a halo over this one...
